RIGHT OF WITHDRAWAL
Right of withdrawal : Pursuant to art. 5 of Legislative Decree 22 May 1999 n. 185, the Customer (if qualifying as a “consumer” pursuant to Article 1 letter b) of Legislative Decree 22 May 1999 no. 185 has the right to withdraw from the contract and to return the ordered Products, without any penalty, within 10 (ten) working days from receipt of the Products.
YOU HAVE NO RIGHT TO WITHDRAW – in the case of cut fabrics or items made exclusively for you; they CANNOT BE RETURNED.
Check carefully that what you ordered corresponds exactly to what you wanted, bearing in mind any differences in shades that may occur from viewing different monitors.
IMPORTANT : fabrics must be checked before being cut and packaged, because in that case, even in the presence of defects, they cannot be returned.
The fabrics are carefully checked before departure in our warehouses, in case some manufacturing imperfection escapes control, the fabric will be promptly replaced, at our total expense. Please notify us immediately, also sending us a photo of the defect found, and Antonietta Tessuti will collect and deliver the new fabric as soon as possible. If the fabric is not immediately available we will contact you to give you the delivery date, if you are not willing to accept it, you will be refunded what you paid as soon as we have received the fabric and checked the defect you found.
TRANSPORTATION OF RETURNS
The transport of returns is always the responsibility of the customer
The right of withdrawal referred to in the previous article must be exercised by the Customer, under penalty of forfeiture, by sending a registered letter with return receipt. to Antonietta Tessuti – Via Pianezza 44 – 10149 TORINO – Italy, within 10 (ten) working days from receipt of the Products. The above communication can be sent, within the same term, also by e-mail or fax to Antonietta Tessuti at 011/0714186, provided that it is confirmed by registered letter with return receipt, within 48 (forty-eight) hours after sending the fax or mail.
All returns (which must be perfectly intact) must be authorized by Antonietta Tessuti Customer Service which will issue the return authorization. Once authorization has been received by e-mail, the Customer can return the Product to the following address: Antonietta Tessuti – Via Pianezza 44 – 10149 TORINO – Italy. Cash on delivery packages will not be accepted.
Once the Products have been received (and their integrity has been verified) Antonietta Tessuti will, as soon as possible, credit the Customer with the cost of the returned Products (as indicated on the invoice), withholding the amount of the shipping costs which will remain permanently at charged to the Customer.
Without prejudice to the possible applicability of mandatory provisions of law for the protection of consumers (as defined pursuant to Article 1 letter b) of Legislative Decree 22 May 1999 no. 185, any dispute connected to these General Conditions, will be devolved to the exclusive jurisdiction of the Court of Turin. Pursuant to and for the purposes of articles 1341 and 1342 of the civil code, the Customer declares to have carefully read and understood and to specifically accept the following clauses of the Antonietta Tessuti General Conditions of Sale.
